Terms of Service & Hosting Subscription Policy
1. Agreement and service
These Terms of Service govern use of Gong Karaoke LLC (“Gong Karaoke,” “we,” “us”) and its website, mobile web application, television interface, karaoke catalog, venue hosting, audience participation, and related services. By creating an account, subscribing, purchasing credits, or using the service, you agree to these Terms and our Privacy Policy. If you use Gong Karaoke for a venue or organization, you represent that you are authorized to act for it.
2. Accounts and acceptable use
Provide accurate registration information, safeguard your login credentials, and promptly report suspected unauthorized access. Do not interfere with service operations, circumvent access controls, misuse credits or voting, harass others, upload unlawful material, or infringe intellectual-property or privacy rights. We may restrict or suspend accounts for violations, subject to applicable law.
3. Hosting subscriptions
Basic Hosting is advertised at $9.95 per month for one venue/location; Premium Hosting is advertised at $19.95 per month for multiple venues, subject to service limits shown at checkout. Subscription prices and billing terms displayed at checkout control for your purchase. Subscriptions renew automatically each billing period unless canceled. Taxes, if applicable, are disclosed during checkout. Changes in price or material terms will be communicated as required by law.
4. Launch free-trial promotion
For eligible hosting subscriptions started during the announced launch promotion, hosting subscription charges are deferred until January 1, 2027, as shown at checkout. A valid payment method may be required to start the trial. Unless you cancel before the first scheduled billing, your selected plan will renew at its stated monthly rate beginning January 1, 2027. The exact trial end, billing date, and amount displayed in your Stripe checkout or subscription record govern if there is any discrepancy.
5. Cancellation and continued access
You may request cancellation through My Hosting Subscription or by contacting support. A cancellation confirmation must identify its effective date. If you cancel an eligible launch trial before its first scheduled charge, our intended policy is to preserve hosting access through December 31, 2026, and prevent the January 1, 2027 subscription charge. For paid subscriptions, cancellation ordinarily takes effect at the end of the current paid billing period unless the confirmation says otherwise or law requires a different result. Access to paid hosting features ends when cancellation becomes effective. A request is not complete until it has been processed and confirmed; contact support promptly if the cancellation control is unavailable. This policy describes the intended customer experience and must be supported by the live billing system before release.
6. Cancellation feedback
We may ask you to select a cancellation reason, such as cost, limited usage, technical difficulties, missing features, venue closure, or other, and may offer an optional comments field. Cancellation will not be conditioned on providing feedback. We use this information to administer cancellations and improve the service as described in our Privacy Policy.
7. Refunds, payment failures, and plan changes
Subscription fees already charged are generally nonrefundable except where required by law or expressly stated in a specific offer. If a payment fails, we may notify you, retry payment through our processor, or suspend subscription-dependent features as permitted by law. Upgrades, downgrades, and any prorated amounts will be shown before you confirm a plan change. If a billing charge is incorrect, contact support promptly.
8. Gong Credits and tips
Gong Credits are a limited-use digital service balance, not cash or a bank account. Advertised uses currently include adding a video to a queue (1 credit) and recording/uploading a performance (6 credits); the app may also provide promotional or daily credits subject to eligibility. Credit-package prices and any applicable limits are displayed at purchase. Credits are generally not transferable or redeemable for cash except where law requires otherwise. Unused purchased credits, refunds, expiration, and account closure are subject to the purchase disclosures and applicable law. Tips are voluntary and processed under the performer payout rules presented in the app; processing fees, eligibility, refunds, and payout thresholds may apply.
9. Music, video, and venue rights
Music, lyrics, compositions, recordings, and audiovisual content belong to their respective rights holders. Gong Karaoke provides limited access through its service only for uses it is authorized to offer; no ownership or independent copyright license passes to users. Do not copy, download, extract, redistribute, rebroadcast, or commercially exploit catalog material outside authorized app features. Available works and permitted features may change or be withdrawn. Venue owners/operators remain responsible for obtaining any additional public-performance, premises, event, or other permissions applicable to their use, unless Gong Karaoke expressly confirms in writing that a particular right is covered. Service availability and music rights may be limited by geography.
10. Performer recordings and uploads
If you record or upload a performance, you represent that you have permission to use your voice, likeness, and all material you contribute, and that your upload does not violate others’ rights. You grant Gong Karaoke a nonexclusive license to host, process, display, transmit, and otherwise use your contributed performance only as needed to operate the features you choose, subject to your settings and applicable law. This user permission does not replace any rights needed in underlying music or third-party recordings. We may remove or restrict content if rights are uncertain, a complaint is received, or continued use would create legal risk. Recording and upload features may be restricted pending rights verification.
11. Live venue participation
Participation may involve displaying your chosen display name, performance information, ratings, votes, tips, and other session activity to hosts and other attendees. Do not attempt to manipulate voting or tip systems, or record or publish other participants without required permission. Hosts are responsible for venue safety, lawful events, and appropriate participant notices.
12. Availability, liability, and changes
The service may experience interruptions, unavailable videos, device incompatibilities, or catalog changes. To the extent permitted by law, the service is provided without a guarantee of uninterrupted availability. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded. We may update these Terms and will provide notice of material changes as required by law.
